Acceptance of Terms
These Terms form a binding agreement between you (“Customer”, “User”) and The Grow Revenue Company Limited (“Company”, “we”, “our”).
By creating an account, subscribing, or otherwise using Flunxx, you confirm that you have read and agree to these Terms, our Privacy Policy, and any referenced policies.
Definitions
“Service” means the Flunxx email-filtering SaaS platform, APIs, browser extensions, and related materials.
“User Data” means all information submitted or processed through the Service.
“Subscription” means a paid plan granting time-limited access to the Service.
“Effective Date” is the date the user first registers or executes a subscription.
Eligibility and Account Responsibility
Users must be 18 years or older and authorised to bind their organisation.
You are responsible for maintaining the confidentiality of login credentials and for all activity occurring under your account.
Grant of Licence
We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms and your chosen plan.
All intellectual-property rights remain owned by The Grow Revenue Company Limited or its licensors.
Acceptable Use
You agree not to:
● Access the Service via automated scripts, bots, or scraping;

● Interfere with security features or reverse-engineer code;

● Use the Service to send spam, malware, or unlawful content;

● Upload illegal, defamatory, or infringing material;

● Resell, sublicense, or provide the Service to third parties without consent.

Violation may result in immediate suspension or termination.

Subscriptions, Fees & Payment
● Subscription fees and billing intervals are stated on flunxx.com/pricing.

● Payments are processed by third-party providers under their own terms.

● All fees are exclusive of applicable taxes unless stated otherwise.

● Subscriptions renew automatically unless cancelled before renewal.

● We may adjust pricing with 30 days’ written notice.

Refunds
Refunds are issued at our discretion in accordance with consumer law and published refund policy.

Trial Periods
Free trials provide limited access for the stated duration.
At trial end, continued use converts automatically to a paid plan unless cancelled.
Service Availability and Support
We aim for 99.9% uptime measured monthly.
Planned maintenance will be announced in advance.
Support is available via support@flunxx.com (Mon–Fri 09:00–17:00 GMT).
Data Protection & Processing
We process personal data strictly in accordance with our Privacy Policy and Data Processing Addendum (if applicable).
You retain ownership of your data.
By using Flunxx you authorise us to process and store data as necessary to provide the Service.
We implement technical and organisational measures appropriate to risk.
Intellectual Property
All trademarks, designs, source code, algorithms, and documentation remain our exclusive property.
Customer logos may be displayed for marketing only with written consent.
Third-Party Integrations
Flunxx may integrate with third-party services (e.g. Gmail API, Outlook API).
Use of those services is governed by their own terms, and we are not responsible for their actions or data handling.
Confidentiality
Each party must protect the other’s confidential information and use it solely for the purposes of this Agreement.
Obligations survive termination.
Indemnification
You agree to indemnify and hold harmless The Grow Revenue Company Limited, its officers, and employees from any claim arising from your misuse of the Service or violation of these Terms.
Disclaimer of Warranties
The Service is provided “as is” without warranties of any kind, express or implied.
We do not guarantee that the Service will be error-free, uninterrupted, or that defects will be corrected immediately.
Limitation of Liability
To the maximum extent permitted by law:
● Our total liability for any claim shall not exceed the total fees paid by you in the 12 months preceding the event;

● We are not liable for indirect, consequential, punitive, or loss-of-profits damages.

Suspension or Termination
We may suspend or terminate access with notice if you:
● Breach these Terms;

● Engage in fraudulent or illegal conduct; or

● Cause risk to service integrity.

Upon termination, your licence ceases immediately and stored data will be deleted after the retention period stated in our Privacy Policy.

Force Majeure
We are not liable for delays or failures caused by events beyond reasonable control, including acts of God, war, strikes, power or Internet outages.
Export Compliance & Sanctions
You warrant that you are not located in or affiliated with entities subject to UK, EU, or US trade sanctions.
You will not export or re-export the Service in violation of applicable laws.
Publicity & Feedback
We may reference your company name and logo in client lists unless you opt out in writing.
Feedback or suggestions you provide may be used without restriction or compensation.
Entire Agreement & Order of Precedence
These Terms, together with the Privacy Policy and any signed order form or Data Processing Addendum, constitute the entire agreement between the parties.
Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
The parties submit to the exclusive jurisdiction of the courts of London, UK.
Amendments to Terms
We may amend these Terms with 30 days’ notice by posting a revised version on flunxx.com/terms.
Continued use after that date constitutes acceptance.
